More than 30,000 lawyers from all over Tamil Nadu and many senior lawyers from across the country congregated at Chennai (some television channels estimated the turnout at 50,000+) joined thousands of lawyers from Chennai taking out a massive rally to focus attention on the lawlessness that has gripped the state characterised by the premeditated brutal attack on lawyers, judges, litigants and the general public in and around the Madras High Court campus on the 19th of February 2009. Mathematically challenged (among other things) sections of the media however preferred to estimate the massive turnout at a modest 5,000. So be it.
After a small rally with a few thousand lawyers having marched to the Memorial Hall, more than a thousand lawyers forming a human chain around the High Court campus, today, ten of thousands of lawyers thronged the procession route from the High Court campus to the State Guest House via the Munro Statue on Mount Road. Seniors and juniors alike, men and women alike, rural and urban alike, the participation in the procession mirrored the unity that has characterised the lawyers struggle for justice.
Lawyers from all over the state thronged to the state capital notwithstanding the fact that given the fact that there has been no financial inflow for most if not all lawyers over the last several weeks now.
The rally was almost entirely regulated by the lawyers themselves, and the fact that the rally went off peacefully with the least possible inconvenience to the general public, lawyers regulated traffic and with the co operation of Exnora International also managed to have the stretch from Periyar Statue (opp the Hindu) to Bells Road cleaned itself must have come as a slap in the face for the police and their political masters.
After the rally, the Joint Action Committee of all bar associations decided to temporarily suspend their agitation and resume attendance at court from Monday, the 23rd of March 2009.

I too noted that the online edition of "The Hindu" quoted that number. Their print edition carried the "news" that "hundreds of advocates" took out a procession yesterday. That could only mean a number between 100 and 999. Is there no limit to their incredulity? Either they can't mouth truth or they write very bad English, or even worse, both are true!
The wikipedia gives a brief history on the origins of "The Hindu" thus: "The British-controlled English language local newspapers had been campaigning against the appointment of the first Indian, T. Muthuswami Iyer, to the Bench of the Madras High Court in 1878. 'The Triplicane Six,' in an attempt to counter the dominant attitudes in the English language press started The Hindu on one British rupee and twelve annas of borrowed money." Sri S. Kasturi Rangan, who was their legal adviser then, purchased "The Hindu" and became its editor. Their association with the "Egmore group" of C. Sankaran Nair and Dr. T.M. Nair (but missing Sir P.T. Thiagarayar and other Justice Party leaders) is also mentioned. Given their long involvement with the nationalist movement and social revolution, it is surprising that they have now chosen to scandalize lawyers unnecessarily at the slightest pretext. When thousands of lawyers participated in the rally, why should it be reported as though only "hundreds" participated? I hope better sense prevails in "The Hindu" and they strive to maintain the standards set by Sri S. Kasturi Rangan, a lawyer himself.
Times of India put the figure at 10,000. Tamil Osai said more than 15,000 lawyers participated in the rally. We should thank the section of the press that maintain better and higher standards of reporting today.
The Hindu is totally biased on this issue from the beginning. In their endeavour to systematically attack lawyers, they campainned against lawyers thrugh their editorial "Telling it as it happened" dated 07.03.2009 and all other subsequent publication of letters against lawyers. I was shocked to note how a retired Supreme Court Judge could give sucha biased report and the editorial made unfounded comments on lawyers praising Srikrishna to skies. In fact, soon thereafter I had responded on at about 1.09 hrs on 08.03.2009 exposing how biased the report of Justice BN Srikrishna was. As the campaign against the lawyers was motivated to safeguard the TN Governement, my response was not published. Here is my response which I had sent it to 'The Hindu' on 07.03.2009:

Sub:- Unruly lawyers started violence, police exceeded limits: Srikrishna vide The Hindu Front Page story on 07.02.2009-Reg.
Lawyers being Court Officers form part of the Justice administration system. The lawyers and judges are one family, they have to see each-other’s face in the day-to-day business of the Courts. The report of one-man Committee of Justice B.N. Srikrishna seems to have rubbed the lawyers on the wrong side. This is not only for the indictment and genaralising lawyers as hooligans and miscreants but because the report of the Committee is vitiated due to bias and onesided approach. The report extensively in about 8 pages dwells on the incidents prior to 19.02.2009 whereas the Supreme Court in its Order dated 26.02.2009 says specifically that that the Committee should inquire into the incident which happened on 19.02.2009.
Besides the above:
1. The Supreme Court in its order has stated that “the terms of reference to the Committee shall be finally decided at the earliest by the Acting Chief justice of the Madras High Court. The Committee is silent on what terms of reference was given.
2. The Supreme Court has specifically mentioned in its Order that the Committee should report on whether any immediate action against the police officers who are allegedly allowed armed policemen to enter the premises of the High Court without permission of Acting Chief Justice. The Committee has failed to answer this point in the report.
3. While the Supreme Court directed that the Committee be given the assistance of two senior police officers attached to CBI Unit (Southern Zone) of the Madras. The report of the Committee is silent as to who are those senior police officers that assisted the Committee.
4. Justice Srikrishna in his report says he had interviews, received number of written representations, affidavits, several CDs containing videos, still photographs of the incident and also recorded versions of a number of persons including concerned Hon’ble Judges of the Madras High Court. However, not a single instance of who and what such persons have stated during the course of interviews or who are the Judges those have given interviews and what they had stated was mentioned in the report.
5. The specific comments made on the Acting Chief Justice that he appears to have merely advised the lawyers to disperse peacefully, the soft-pedaling policy followed by the Madras High Court Judges has led to the present piquant situation are all unwarranted and outside the scope of the order of the Supreme Court. In such unpleasant and unexpected turn of events, it is but natural that no judge could have acted in a better way than the dignified way it was handled by the Madras High Court Judges, especially by the Acting Chief Justice.
6. The report says that “once the policemen were given the order to lathi charge the unruly mob of lawyers to quell them it would appear that the police interpreted it as a license to unleash mayhem at will”. This is purely a surmise of the Committee. The Committee should confine itself to what it has seen, heard or happened. Strangely, the Committee does not mention who has given the order to lathi charge.
7. The report is emphatic on the rampage of the police who came in armed with lathis, wore helmets and shields. The police have barged into the Court rooms of the Judges of the Small Causes Court and Family Court within the High Court complex and indulged in deliberate destruction of the tables, chairs, fans, computers, Xerox machine, and other articles. Further they went to the lawyers’ chambers not only in the High Court premises but in Linghi Chetty Street, Thambu Chetty street, Armenian street, Sunkurama Chetty Street, Kondichetty Street and Baker Street in the vicinity of the High Court, systematically barged into their chambers, caused damage and beaten up some of the lawyers. It is reported that even the lady lawyers or children’s creche were not spared. When this is so, the report does not specifically name the Police Officers at whose command the police have resorted to riots and unruly violence. Surprisingly when so much violence was reportedly resorted to by the Police in the report, the Committee gives a clean-chit to the Police commissioner “As far as the Commissioner of Police is concerned, I do not think that any blame can be laid at his door”. It is sad to note that the Committee which does not spare the lawyers or even the judges of the Madras High Court had shown such a soft-corner to the Police Commissioners who alone should be blamed for the police excesses on 19.02.2009.
Even there are many contradictory incidents that the Police Commissioner was present in the High Court premises prior to 4.30 p.m. on 19.02.2009 according to an FIR, whereas the report is categorical that the Commissioner is present only after 17.14 hrs.
It is not clear how Justice Srikrishna could withdraw from the Committee by merely submitting an interim report. Who will submit the final report?
These comments on the report demonstrate how the Committee went wrong on various issues and how the report is biased and one-sided. This type of reports will only rub the lawyers on the wrong side and aggravate the situation unnecessarily.
In support of my above response, I have attached the copy of the Supreme Court's Order dated 26.02.2009 appointing Justice BN Srikrishna as a one-man Committee and the Report of Srikrishna dated 04.03.2009.

Even though several other letters praising the editorial and Srikrishna's report were published, my response based on the strength of contradictory evidence and materials was not published. This proves beyond any doubt the media 'The Hindu'is biased.
I was present yesterday in the rally and represented from Pondicherry Bar Association. I have seen with my own eyes that at least 35 to 40000 lawyers all over Tamilnadu and even from other states participated in the rally.The numbers could be even more.
ReplyDeleteIt was a massive rally organized by the joint action committee against the police attack on judiciary. Though there were more than 75000 lawyers participated in the rally, no policemen were found throughout the rally route and only the lawyers have regulated the traffic for its smooth flow and the entire rally was incident free. Every lawyer was seen in black coats and everyone followed the instructions given by the joint action committee. police stations enroute were given proper protection by the lawyers volunteers who were seen guarding the police stations and some important points enroute. The rally signalled that majesty of law and rule of law prevails and no one can take law into their hands. Senior lawyers from various bar associations from the state have leaded the rally which ended at Chepauk with a meeting organized by the joint action committee. Since two police officers were ordered to be suspended by the High Court of Madras, the lawyers agitation was suspended and all lawyers in the state will resume work from 23-03-2009 ending a month long agitation by the lawyers over the attack on judiciary by the policemen on 19-02-2009.

The news reported about the lawyers agitation by "The Hindu" is contrary to the facts right from the beginning. The Hindu had lost its credibility in reporting news due to some obvious reason.

I was in Tel Aviv once and I was reading the Israeli newspaper. It was the day after a lot of attacks and bombardments and deaths had taken place. The Hamas had struck. But the front page of the newspaper had the picture of a Jewish gentleman who in five years had transformed his desert land into an orchid and a granary. It was this inspiring picture that everyone woke up to. The gory details of killings, bombardments, deaths, were inside in the newspaper, buried among other news.
In India we only read about death, sickness, terrorism, crime. Why are we so NEGATIVE?
Another question: Why are we, as a nation so obsessed with foreign things? We want foreign TVs, we want foreign shirts. We want foreign technology. Why this obsession with everything imported.
Do we not realize that self-respect comes with self-reliance?
I was in Hyderabad giving this lecture, when a 14 year old girl asked me for my autograph. I asked her what her goal in life is: She replied: I want to live in a developed India. For her, you and I will have to build this developed India. You must proclaim. India is not an under-developed nation; it is a highly developed nation.
Allow me to come back with vengeance. Got 10 minutes for your country?
YOU say that our government is inefficient. YOU say that our laws are too old. YOU say that the municipality does not pick up the garbage. YOU say that the phones don't work, the railways are a joke, the airline is the worst in the world, mails never reach their destination. YOU say that our country has been fed to the dogs and is the absolute pits. YOU say, say and say.
What do YOU do about it? Take a person on his way to Singapore. Give him a name - YOURS. Give him a face - YOURS. YOU walk out of the airport and you are at your International best. In Singapore you don't throw cigarette butts on the roads or eat in the stores. YOU are as proud of their Underground Links as they are. You pay $5 (approx. Rs. 60) to drive through Orchard Road (equivalent of Mahim Causeway or Pedder Road) between 5 PM and 8 PM.
YOU comeback to the parking lot to punch your parking ticket if you have over stayed in a restaurant or a shopping mall irrespective of your status identity. In Singapore you don't say anything, DO YOU? YOU wouldn't dare to eat in public during Ramadan, in Dubai. YOU would not dare to go out without your head covered in Jeddah. YOU would not dare to buy an employee of the telephone exchange in London at 10 pounds (Rs. 650) a month to, "see to it that my STD and ISD calls are billed to someone else." YOU would not dare to speed beyond 55 mph (88 kph) in Washington and then tell the traffic cop, "Jaanta hai sala main kaun hoon (Do you know who I am?). I am so and so's son. Take your two bucks and get lost." YOU wouldn't chuck an empty coconut shell anywhere other than the garbage pail on the beaches in Australia and New Zealand. Why don't YOU spit Paan on the streets of Tokyo? Why don't YOU use examination jockeys or buy fake certificates in Boston? We are still talking of the same YOU. Will the Indian citizen do that here?" He's right. We go to the polls to choose a government and after that forfeit all responsibility. We sit back wanting to be pampered and expect the government to do everything for us whilst our contribution is totally negative. We expect the government to clean up but we are not going to stop chucking garbage all over the place nor are we going to stop to pick a up a stray piece of paper and throw it in the bin. We expect the railways to provide clean bathrooms but we are not going to learn the proper use of bathrooms. We want Indian Airlines and Air India to provide the best of food and toiletries but we are not going to stop pilfering at the least opportunity. This applies even to the staff who is known not to pass on the service to the public. When it comes to burning social issues like those related to women, dowry, girl child and others, we make loud drawing room protestations and continue to do the reverse at home. Our excuse? "It's the whole system which has to change, how will it matter if I alone forego my sons' rights to a dowry." So who's going to change the system? What does a system consist of? Very conveniently for us it consists of our neighbors, other households, other cities, other communities and the government. But definitely not me and YOU. When it comes to us actually making a positive contribution to the system we lock ourselves along with our families into a safe cocoon and look into the distance at countries far away and wait for a Mr. Clean to come along & work miracles for us with a majestic sweep of his hand. Everybody is out to abuse and rape the country. Nobody thinks of feeding the system. Our conscience is mortgaged to money.
Dear Indians, The article is highly thought inductive, calls for a great deal of introspection and pricks one's conscience too....I am echoing J.F. Kennedy's words to his fellow Americans to relate to Indians.....
"ASK WHAT WE CAN DO FOR INDIA AND DO WHAT HAS TO BE DONE TO MAKE INDIA WHAT AMERICA AND OTHER WESTERN COUNTRIES ARE TODAY"

The Internet is a viable alternative to the print media. The speech is actually a poser to the legal fraternity here. There could be real progress if we could use the Internet more effectively and vigorously.

மும்பையில் முதலில் தாக்குதலுக்கு உள்ளான சத்ரபதி சிவாஜி ரயில் நிலையம் தான் மும்பையின் உண்மையான அடையாளச் சின்னம். இங்குதான் இந்தியாவின் எல்லா மாநிலங்களிலிருந்தும் குறிப்பாக பீஹார், உத்தரப் பிரதேசம், மேற்கு வங்கம், தமிழ்நாடு முதலியவற்றிலிருந்து சக இந்தியர்கள் தினசரி வந்து இறங்கி மும்பையையும் தங்களையும் கடும் உழைப்பால் வளர்த்துக் கொண்டிருக்கிறார்கள்.
இந்த ரயில் நிலையத்தின் நடை மேடையில்தான் அறுபது பிணங்கள் முதலில் விழுந்தன.
ஆனால் இன்று வரை ஒரு சேனலும் இந்த ரயில் நிலையக் காட்சிகளைக் காட்டவில்லை. நட்சத்திர ஓட்டல்களான தாஜ், ஓபராய் இரண்டிலும் உடைந்த சோபாக்கள், எரிந்த திரைச் சீலைகளைக் காட்டுவதற்கு இந்தியாவின் நம்பர் ஒன் பெண் டி.வி அறிவிப்பாளர் பர்க்கா தத் முண்டியடித்துக் கொண்டு காமராவுடன் அலைகிறார். ஆனால் அரசு மருத்துவமனையில் இன்னமும் அடையாளம் தெரியாமல் கிடந்துகொண்டிருக்கும் ரயில் நிலையப் பிணங்களையோ, அடையாளம் தெரிந்த பிணங்களைப் பெற்றுச் செல்ல சாதாரண மக்கள் படும் பாட்டையோ எந்த டி.வி சேனலும் கண்டுகொள்ளவே இல்லை.
பயங்கரவாதத் தாக்குதல்களினால் மும்பை நகரமே ஸ்தம்பித்துப் போய் விட்டதைப் போன்ற ஒரு மாயத் தோற்றத்தை இந்த சேனல்கள் ஏற்படுத்தின. அப்படி எதுவும் நடக்கவில்லை. சிவாஜி ரயில் நிலையம் மறு நாள் விடியற்காலையிலிருந்து இயங்கத் தொடங்கிவிட்டது. பயங்கரவாதிகளின் முற்றுகை நீடித்த இடங்களான ஹோட்டல் தாஜ், ஓபராய், நாரிமன் பவன் என்ற யூதர் குடியிருப்புக் கட்டடப் பகுதிகளைத் தவிர மீதி மும்பை சகஜமாக செயல்பட்டுக் கொண்டுதான் இருந்தது.
மும்பையின் சாதாரண மக்களின் அன்றாட வாழ்க்கையில் தாஜ், ஓபராய் ஹோட்டல்களுக்கு எந்தத் தொடர்பும் இல்லை. மும்பையின், இந்தியாவின், உலகத்தின் மிகப் பெரும் பணக்காரர்கள் மட்டுமே புழங்கும் இடங்கள் அவை. தாக்குதலைப் பதிவு செய்ய 60 மணி நேரம் தாஜ் ஓட்டலுக்கு வெளியே முகாமிட்டிருந்த சுமார் 300 டி.வி நிருபர்கள், ஒளிப்பதிவாளர்களில் பத்துப் பதினைந்து பேரைத் தவிர வேறு யாரும் சாதாரண நாட்களில் அந்த ஹோட்டலுக்குள் போய் ஒரு காபி கூடக் குடிக்க முடியாது.
தினசரி 60 லட்சம் பயணிகளை காலையும் மாலையும் சுமந்து சென்று வரும் மும்பையின் உள்ளூர் ரயில்களில் குண்டு வெடித்தபோது, அதில் நூற்றுக்கணக்கான சாதாரண மக்கள் இறந்தபோது, மும்பை நகரமே தாக்கப்பட்டுவிட்டதாகவோ, இந்தியாவே தாக்கப்பட்டுவிட்டதாகவோ கூக்குரல் எழுப்பாத இந்த சேனல்கள், நட்சத்திர ஓட்டல்கள் மீதான தாக்குதல்களின் போது மட்டும் ஓவராக புலம்பி வருவது ஏன் ?
இந்தியாவை ஆட்டிப் படைக்கும் அதிகார சக்திகளின் சந்திப்பு இடம் இவை. பெரும் தொழிலதிபர்கள், உலக வர்த்தகர்கள், அரசியல் பிரமுகர்கள், இடைத்தரகர்கள், சினிமா நட்சத்திரங்கள், சினிமா, அரசியல், பயங்கரவாதம் அத்தனைக்கும் நிதியுதவி வழங்கும் மாஃபியா ரவுடி கும்பல் தலைவர்கள் தினசரி இந்த ஹோட்டல்களில்தான் சந்திக்கிறார்கள். நடைபாதையில் தூங்கும் சாதாரண மக்கள் மீது கார் ஏற்றிக் கொன்றுவிட்டு, காரை ஓட்டியது தானல்ல, டிரைவர்தான் என்று இன்னொரு சாதாரண மனிதனைச் சிறைக்கு அனுப்பி வைக்கும், பணக்கார வீட்டுப் பொறுக்கி வாரிசுகள்தான் லியோபோல்ட் கிளப்புகளின் முக்கிய வாடிக்கையாளர்கள்.
அதிகாரத்தின் சின்னம் இந்த ஹோட்டல். தேசத்தின் சின்னமோ, மக்களின் சின்னமோ அல்ல.
அதனால்தான் பயங்கரவாதிகள் இந்த முறை இதைத் தேர்ந்தெடுத்துத் தாக்கியிருக்கிறார்கள். சாதாரண மக்களைத் தாக்கி எந்தப் பயனும் இல்லை என்பது பயங்கரவாதிகளுக்கும் புரிந்து விட்டது. மார்க்கெட்டில், பஸ்களில், ரயிலில் குண்டு வைத்தால், சாதாரண மக்கள் சாகிறார்கள். ஆனால், மறு நாளே சகஜ நிலைக்கு வந்துவிடுகிறார்கள். எதுவுமே நடக்காதது போல அவரவர் வேலைக்குப் போகிறார்கள். ஆட்சி அதிகாரத்தில் இருப்பவர்களும், சாதாரண மக்கள் சாகும்போது, எதுவுமே நடக்காதது போல தங்கள் ஊழல் அராஜக ஆட்சிப் பணிகளைத் தொடர்கிறார்கள்.
நட்சத்திர ஓட்டல்களை தாக்கிய வுடன்தான் அதிகார சக்திகளுக்கு பதற்றம் ஏற்படுகிறது. அவர்களை அண்டிப் பிழைக்கும் டி.வி சேனல்கள் எல்லாம் ஒப்பாரி வைக்கின்றன. `பொறுத்தது போதும். பொங்கி எழு' என்கின்றன.

தேச நெருக்கடி என்றால் அரசியல்வாதிகள் கருத்து வேறுபாட்டை ஒதுக்கிவிட்டு ஒன்று சேரவேண்டுமாம். அந்த நேரத்தில் அரசியல் செய்யக்கூடாதாம். சரி. சேனல்கள்? அவை எப்படி நடக்க வேண்டும்? அவையும் ஒவ்வொரு இடத்துக்கும் தனித் தனி கேமரா, தனித் தனி நிருபர் அனுப்பாமல், ஒளிப்பதிவை, பேட்டிகளை பகிர்ந்துகொள்ளலாமே. மிச்சப்படும் நிறைய பேரை இன்னும் அதிக இடங்களுக்கு அனுப்பலாமே. மாட்டார்கள். சேனல்களில் பத்து நிமிடத்துக்கொரு முறை என்ன சொன்னார்கள் தெரியுமா? `இந்த செய்தி எங்கள் சேனலின் பிரத்யேக செய்தி. இதை முதலில் சொன்னது நாங்கள்தான்.'

சேனல்களின் தொடர் பிரசார அரசியல் வெற்றி பெறுகிறது என்பது இன்னொரு வேதனை. பாபர் மசூதி இடிப்புக்கு, பாராளுமன்றம் தாக்கப்பட்டதற்கு, பஸ், ரயில் குண்டு வெடிப்புகளுக்கு, குஜராத் கோவில் தாக்குதலுக்கு, முஸ்லிம்கள் படுகொலைக்கு, ஆயிரக்கணக்கான விவசாயிகள் கடன் தற்கொலைக்கு ராஜினாமாக்கள் இல்லை. ஆனால் நட்சத்திர ஓட்டல் தாக்குதலுக்கு ஒரு மத்திய உள்துறை அமைச்சர், மாநில முதலமைச்சர், உள்துறை அமைச்சர் என்று மூன்று தலைகள் உருட்டப்பட்டிருக்கின்றன.
எல்லா அரசியலும் எல்லா அரசியல்வாதியும் மோசம் என்ற கருத்தை இந்த சேனல்கள் பரப்புகின்றன. ஒரு சர்வாதிகாரி நாட்டுக்குத் தேவை என்ற மனநிலையை மறைமுகமாகப் பரப்புகின்றன. சர்வாதிகாரிகளும் பயங்கரவாதிகளும்தான் பணக்காரர்களுக்கு உகப்பானவர்கள். ஏனென்றால் பேரம் பேச வசதியானவர்கள் அவர்கள்தான். ஜனநாயகத்தின் அரசியல்வாதிகள் ஒரு கட்டத்துக்கு மேல் மக்களுக்கு பயந்தாக வேண்டும்.
மக்களின் கோபத்தைத் தூண்டிவிட்டு அரசியல்வாதிகளின் மீதான ஒட்டுமொத்த அவ நம்பிக்கையை ஏற்படுத்துவது ஜனநாயகத்துக்கே ஆபத்தானது. எல்லை கடந்த பயங்கரவாதத்தை விட ஆபத்தானது இந்த உள்ளூர் பயங்கரவாதம். கத்தியின்றி ரத்தமின்றி நடத்தப்படும் இந்த யுத்தம் நம் உடல் மீது அல்ல, உள்ளத்தின் மீது, சிந்தனை மீது. உஷாராக இருப்போம்..
